1. No Guaranteed Sales or Results
FSI Ops does not guarantee sales, leads, bookings, revenue, return on ad spend, or any specific business outcome.
The system is designed to make marketing more measurable and improve the chances that real demand turns into booked, paid work.
FSI Ops may help identify demand, improve lead visibility, organize follow-up, connect marketing activity to outcomes, and reduce gaps between inquiries and booked work. Results depend on factors outside of FSI Ops' control, including market conditions, advertising budget, offer quality, pricing, responsiveness, sales process, competition, client follow-up, and third-party platforms.
2. Scope of Services
FSI Ops may provide dashboards, reporting, workflow setup, lead tracking, marketing insight tools, operational systems, automation support, and related consulting services.
Specific deliverables, timelines, integrations, and recurring services may vary by client agreement or selected service package.
3. Client Responsibilities
Clients are responsible for providing accurate business information, maintaining access to required accounts, reviewing and approving advertising spend, responding to leads in a timely manner, and operating their own business.
FSI Ops is not responsible for missed opportunities caused by delayed follow-up, inaccurate information, unavailable staff, pricing decisions, service quality, scheduling limitations, or decisions made by the client.
4. Advertising Spend and Third-Party Fees
Advertising budgets, software subscriptions, call tracking fees, CRM fees, payment processor fees, and other third-party platform costs are separate from FSI Ops service fees unless explicitly stated in writing.
Clients are responsible for all approved advertising spend and third-party charges associated with their accounts.
5. Third-Party Platforms
FSI Ops may connect with or rely on third-party tools and platforms, including Google, Meta, CRM systems, scheduling tools, call tracking platforms, analytics tools, payment processors, and automation platforms.
FSI Ops is not responsible for outages, policy changes, account suspensions, tracking limitations, reporting delays, platform errors, inaccurate third-party data, denied advertising accounts, or changes made by third-party providers.
6. No Professional Advice
FSI Ops services are operational and marketing-support tools. They do not constitute legal, tax, financial, accounting, insurance, or professional business advice.
Clients should consult qualified professionals for decisions involving legal, tax, financial, regulatory, or compliance matters.
7. Limitation of Liability
To the fullest extent permitted by law, FSI Ops will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, missed opportunities, or business interruption.
Where permitted by law, FSI Ops' total liability for any claim related to services will not exceed the amount paid by the client for the affected service during the three months before the claim arose.
8. Changes to These Terms
FSI Ops may update these Terms of Service from time to time. Continued use of the website, dashboard, systems, or services after updated terms are posted constitutes acceptance of those changes.
9. Governing Law
These Terms of Service are governed by the laws of the State of Illinois, without regard to conflict of law principles.
